Undang-Undang Pekerjaan dan Perhubungan Perusahaan di Malaysia

Undang-undang pekerjaan (employment law) dan perhubungan perusahaan (industrial relations) mengawal hubungan antara majikan dan pekerja di Malaysia. Dua undang-undang utama ialah Akta Kerja 1955 (Employment Act 1955) yang mengawal terma pekerjaan, dan Akta Perhubungan Perusahaan 1967 (Industrial Relations Act 1967) yang mengawal pertikaian perusahaan dan pembuangan kerja.

Pindaan Akta Kerja 1955 pada tahun 2022 meluaskan perlindungan kepada semua pekerja tanpa had gaji - perubahan besar yang sebelum ini hanya melindungi pekerja bergaji RM 2,000 ke bawah.

Pembuangan Kerja dan Mahkamah Perusahaan

Pembuangan kerja tidak adil (unfair dismissal) ialah isu paling kerap di Mahkamah Perusahaan (Industrial Court). Pekerja yang dibuang kerja boleh memfailkan aduan di Jabatan Perhubungan Perusahaan dalam tempoh 60 hari. Proses:

  1. Aduan di Jabatan Perhubungan Perusahaan (JPP)
  2. Percubaan rundingan damai (conciliation)
  3. Jika gagal, Menteri merujuk kes ke Mahkamah Perusahaan
  4. Mahkamah mendengar kes dan membuat award - pengembalian kerja (reinstatement) atau pampasan (back wages sehingga 24 bulan)

What happens if I am unfairly dismissed in Malaysia?
